A few weeks back, I was discussing with a well-seasoned HR professional various subjects related to HR, in which, interestingly, the topic of Workplace safety and Sexual Harassment came up. We had an extended discussion on the topic. At the end of the conversation, I realized how less informed we are when it comes to Laws and Acts related to the workplace, one such a topic is POSH.
Many organizations mistakenly view the Prevention of Sexual Harassment (POSH) Act as just another legal checklist to satisfy human resources records. However, the reality is far more profound. Enacted in 2013 to ensure women’s right to workplace equality and safety, the POSH Act is a powerful catalyst for organizational transformation. When implemented with genuine intent, POSH compliance goes far beyond legal adherence—it protects employees, cultivates a culture of respect, and serves as a strategic driver for business growth.
When it comes to understanding the POSH Act as well as implementing it in MSMEs, especially in labour-intensive industries such as Textile and Apparel production is significantly challenging. A workplace where sexual harassment remains unaddressed can negatively affect women’s well-being, confidence, and productivity.
Despite the POSH Act being in force for over a decade, compliance remains weak, with many organisations failing to report the learnings from the established Internal Complaints Committees (ICCs) or disclose mandatory data on harassment complaints.
So, understanding POSH and implementing it for the benefit of our business is imperative and has to be taken as a serious business case to establish the best practices on HR & Empowerment.
